Amarillo, TX - The Occupational Safety and Health Administration (OSHA) is investigating a fatal workplace accident that happened Tuesday in Amarillo.

At 1:04 Tuesday afternoon, officers responded to HD Wrecker Service at 6116 Canyon Drive and found 39-year-old James Gallaway dead and 33-year-old Kristen Messer with serious injuries.

Police said the two employees were working under a pickup truck that was attached to a fork lift. The truck fell off the fork lift onto both employees. Kristen Messer was transported to a local hospital by ambulance and her injuries are reported as non-life threatening.

According to OSHA's powered industrial truck standard, "no person shall be allowed to stand or pass under the elevated portion of any truck, whether loaded or empty." The agency will be investigating whether the company violated OSHA's safety standards.

NewsChannel 10 reached out to HD Wrecker Service Wednesday, but the company declined to comment on the incident and said it was working with their lawyers.
