Employees of the Swift plant in Cactus arrested by federal agents are still entitled to get paid under Texas law... According to an immigration lawyer in Amarillo.
Nelli Nikova of the Underwood Law Firm in Amarillo tells us after extensive research, she has not found anything in the Texas Labor Code that says aliens are excluded from the definition of employees...making them eligible for wages regardless of their legal status.
"Immigration law basically does not explicitly provide that working as an unlawful alien is illegal. It does not impose sanctions on the unlawful worker for accepting work."
Nikova says in other cases the employer has delivered the check by mail or an authorized family member has picked it up.
