Clovis man found guilty of aggravated battery with a deadly weapon

CLOVIS, N.M. (KFDA) -

Ninth Judicial District Attorney Andrea Reeb announced that 47-year-old Robert J. Burke, of Clovis, was found guilty this afternoon by a Curry County jury of Aggravated Battery with a Deadly Weapon after a two-day trial. 

Burke was arrested on Sept. 22, after he struck another man with a metal baseball bat while the man was getting out of his car at his residence. 

The victim was taken by ambulance to the hospital for treatment of injured ribs.  

The case was delayed by competency issues for Burke and treatment at the New Mexico Behavioral Health Institute in Las Vegas, NM.  Ultimately, Burke was deemed competent to stand trial.

The Honorable Drew D. Tatum presided over the trial and ordered that sentencing be held at a later date. Burke faces a minimum of 3 years in prison. 

The State intends to file habitual offender information on Burke which would further enhance his sentence.

Burke is pending separate charges for Aggravated Assault and Intimidation of a witness.
