Civil lawsuit against Curry County Detention Center claims assault on an inmate

Curry County, NM - A civil rights lawsuit filed against the Curry County Detention Center claims assault and battery against an inmate.

The lawsuit was filed against not only against the jail, but the jail administrator and the jailer.

Portales attorney, Eric Dixon says the incident happened in late March. Dixon says his client, Robert Webber was denied juice by a jailer who then violently shut the food port on Webber's arm. 

The jailer, Jonathan King, has been fired by the county as a result of the incident and plead no contest to battery on Webber. 

The lawsuit complains of systemic failure in the jail to prevent this violence. Dixon says the lawsuit describes the jail as unsafe, unhealthily, and dangerous to essentially anyone. 

Webber is asking for $750,000 in damages and injunctive relief against the defendants.

The Curry County manager, Lance Pyle says they have not been served yet, and since it is pending litigation they have no comment at this time.
