Former area sheriff may agree to a plea deal next week

Randall County, TX - Next week former Swisher County Sheriff Emmett Benavidez could enter as plea in a criminal case he's faced since last October.

Randall County District Attorney James Farren said the former sheriff has agreed to plead guilty on Monday to a charge of official oppression.

The criminal case claims Benavidez repeatedly fondled himself in front of two of his female employees while traveling through Randall County on business.

The incident was captured in an hour-long cell phone video that backs up the claim. Farren said the cell phone video also gives his office jurisdiction because the video shows landmarks that prove the incident happened in Randall County.

Farren said the charge of official oppression is a Class A misdemeanor and they have finally come to a plea deal agreement with Benavidez's attorneys. "We have offered him one year of straight probation. Now this is a misdemeanor. As a condition of that probation, he has to serve 30 days in the county jail,"Farren said.

Benavidez will also be required to complete community service along with counseling if he does enter the plea of guilty on Monday.

"He'll also have more than one requirement for counseling about dealing with members of the opposite sex and appropriate verbiage and actions when you're dealing with someone of the opposite sex."
