Man charged with Intoxication Assault in connection to McDonald's accident

Amarillo, TX - The Amarillo Police Department interviewed everyone involved during their 4th month investigation. 

Now a toxicology report released Wednesday states the driver of the semi truck was under the influence of alcohol when the accident happened. 

47th District Attorney for Potter County, Randall Simms says he will face one count of Intoxicated Assault. 

Police identify the semi driver as 30-year old Daniel Bryan. He turned himself into the Potter County Correction Center last night. 

"Now that the complaint has been filed, at some point this case will be taken to the Grand Jury for a review to decide to return a true bill of indictment or not," said Simms. 

Intoxication Assault is a 3rd degree felony and could have repercussions of 2-10 years in jail. 

Local defense attorney, Dean Boys says a case like this has several aspects that need to be considered. 

"There's several people that got hurt and McDonald's had a tremendous amount of property damage. The McDonald's has been shut down for four months and lost income for those months," said Boyd. 

Boyd also says the insurance company for the semi truck has a $1 million policy, which might not be enough for all the possible claims in this case. 

"Each individual case could have a big number against him. So, now you start looking to see if the trucking company has any assets," said Boyd. 

As this case continues to unfold, we will see if the trucking company or Bryan will pay for the damages. 

"If a jury understands he didn't just make a mistake, he was drunk and he hurt people. That changes how a jury is going to look at this case," said Boyd. 

According to the Potter County Correction Center, Bryan bonded out today for $10,000.
