Houston, TX -   The mental state of a Texas death row inmate has halted his execution. A federal appeals court has halted the scheduled execution of a convicted killer in Texas so his attorneys can pursue appeals as they claim he is mentally impaired and ineligible for the death penalty.

Robert James Campbell was set to be put to death Tuesday evening. This would have been the first U.S. inmate executed since a botched execution in Oklahoma two weeks ago.

A doctor diagnosed Campbell with mild mental retardation, but he passed one IQ test and now, his lawyers claim the Texas Department of Criminal Justice withheld results of a second IQ test that he failed.

There is no word yet on how long this delay will go on for, but Campbell's lawyer's claim they have not had a fair opportunity to develop these mental impairment claims.
