Amarillo, TX - The only survivor in an August car crash that killed five "TEXAS" cast members is dropping his lawsuit against The Batson Foundation. Timothy Johnson, is dropping his claim that Joe Batson, The Batson Coldwater Cattle Company and The Texas Panhandle Heritage Foundation were negligent as their role as party hosts. Five cast members died after the driver failed to yield to the right of way and pulled in front of a semi truck. The driver had traces of marijuana in his system and had twice the legal driving limit of alcohol in his system. Johnson was seeking one-million dollars in damages.
