
SANTA FE, N.M. (AP) - New Mexico Supreme Court Justices heard arguments in an animal cruelty case against a Texas horse trainer accused of beating a colt to death. 3 of the five justices listening to arguments Tuesday in Santa Fe were skeptical of Greg Collier's attorney's arguments that Collier cannot be tried a third time for animal cruelty.
Collier's past trials in Las Cruces ended in mistrials.
The 41-year-old Collier says the case against him should be tossed because of double jeopardy, statute of limitations expirations and a violation of his right to a speedy trial.
The Las Cruces Sun-News reports the prosecution of Collier began more than five years ago when Collier was hired to train a race horse named Cowboy.
Prosecutors alleged that Collier was "humiliated" over his lack of progress and struck the horse repeatedly with the whip handle.
