West Texas engineer guilty in 'rape kit' case

MIDLAND, Texas (AP) — A West Texas petroleum engineer has been convicted over what police say involved a "rape kit" or other items needed for a kidnapping.

The penalty phase was scheduled Friday for 49-year-old Juan Jose Guerra of Big Spring.

Jurors in Midland on Thursday convicted Guerra, who did not testify, of possession of a criminal instrument with the intent to commit aggravated kidnapping and aggravated sexual assault. He faces a possible two to 20 years in prison.

Midland police on April 28, 2010, arrested Guerra outside a dance school. Investigators say Guerra had two handguns, a stun gun, tape, gloves, plastic ties, personal lubricant and condoms in his vehicle.

The defense says Guerra used duct tape and the plastic ties for target practice and that there was no victim.
