Attorneys await ruling in Leach lawsuit appeal

LUBBOCK, Texas — Attorneys for Texas Tech and Mike Leach have argued their respective sides in the former coach's lawsuit over his firing.

Now, they await a ruling from a three-judge panel of the Amarillo-based 7th Court of Appeals on whether the case will proceed.

Leach attorney Paul Dobrowski argued Thursday that the university's conduct surrounding Leach's firing waived its ability to claim protection by sovereign immunity.

University attorney Sean Jordan argued that Leach in his depositions doesn't deny he confined a player who got a concussion in a dark place.

The appeals court is under no deadline to issue its ruling.

The university fired Leach Dec. 30, two days after suspending him amid allegations he mistreated the player. Leach has denied the claim.
