APD Press Release, 7-29-10

DATE: July 29, 2010
TIME: 1:50 AM
CASE NUMBER: 2010-0507154
INCIDENT TYPE:  Aggravated Assault

DETAILS: At approximately 1:00 AM, on Thursday July 29, 2010, Officers Michael Mogelinski and Anthony Kennedy were told of a large fight that was going to occur at closing time at the Sorority Club at 4901 S. Washington. At around 2 AM, Off. Mogelinski and Off. Kennedy, who were riding together as a 2-man unit, spotted up on the Club from across Washington Street. The officers witnessed a large crowd estimated at around 50 people exit the club and a fight break out. They approached this group on foot and observed a black male armed with a knife in the crowd. The officers ordered the crowd to break-up and finally used OC (pepper spray) to break up the crowd.

The man armed with the knife slipped away and was not seen again. As this crowd was breaking up the officers observed a second subject firing a small caliber semi-automatic into the air. The officers approached this subject and ordered him to drop the weapon. This subject made a sweeping motion with the gun from pointing upwards to pointing the gun at the officers. At this time Officers Mogelinski and Off. Kennedy fired a total of 7 shots from their duty weapons striking the suspect 4 times.

The suspect later identified as Markeen Walker, B/M 17, of Amarillo fell to the ground and he and the gun were taken into custody. At this point a large crowd gathered around the officers and began throwing bottles and rocks at Off. Mogelinski and Off. Kennedy. The officers called for help and an ambulance for Walker. Officers from the APD, PCSO, RCSO and DPS responded to the scene to help the officers on a crowd the officer estimated to be near 100 people. This crowd was broken up and left the scene. Paramedic's treated Walker on the scene prior to being transported to a local hospital.

After the crowd was broken up a second person was located that had been shot. Christopher Bailey, B/M 28, of Amarillo was found to be suffering from a wound to his buttock area. Mr. Bailey was taken to a local hospital for treatment. At the hospital it was determined that Walker had wounds in his upper body as well as his legs. Walker was admitted into ICU and is currently listed in Critical Condition. Mr. Bailey was taken into surgery where he is currently listed in Critical but stable condition. At this point in the investigation it is unknown if Mr. Bailey was struck by a bullet fired by the officers or by Walker.

As the investigation continues we believe we will be able to clear up this issue. Two additional arrests were made during this incident one for Interfering with the Arrest and another for Underage Consumption of Alcohol. Neither officer received a significant injury during this incident. At the time of the this news release no witnesses have come forward to report what they observed even though there was a large crowd present and several people who were witnessed recording this event on their cell phones when the first officers arrived.

Anyone with information is asked to call the Special Crimes Unit at 378-9468. This incident is being actively investigated at the time of this release. The officers involved have been placed on 3 days administrative leave per departmental procedures. The results of this investigation will be turned over to the Randall County District Attorney's office when complete.
